Breaking News: FLSA Salary Increase Overturned

November 15, 2024

Today a Texas federal district court found that the U.S. Department of Labor exceeded its authority in issuing regulations that would have increased the salary threshold to $58,656 for “white collar” overtime exemptions effective January 1, 2025.

So for now, employers may breathe a sigh of relief.  However, it is anticipated that the new Trump Administration will revisit this issue (as it did in 2016) and more developments may be on the horizon.  But for now employers can press “pause” and finish out 2024 without this significant change hanging over their heads.

Employers are encouraged to consult with their employment and labor law counsel and to review their policies and practices to ensure compliance with applicable law.
