Mark focuses his practice on representing plaintiffs in significant personal injury and wrongful death litigation, including claims involving product liability, motor vehicle negligence, premise liability, and workplace injuries resulting from a third-party’s negligence. Mark has significant litigation experience in federal court and state courts  from Omaha to Valentine to North Platte to Red Cloud and almost everywhere in between.

  • Severe Traumatic Brain Injury Case – 14-year-old Student – 2019
    Liability: Client was a passenger in a vehicle that lost control on an icy road resulting in a head-on collision with another vehicle.
    Injury: Severe traumatic brain injury including multiple brain bleeds and long term memory and processing issues.
    Result: High Six-Figure settlement for 3.5 times more than the liability insurance company was offering the client before retaining our services.
  • Premise Liability – 74-year-old woman – 2019
    Liability: Client was injured at the premise of an acquaintance after being struck by an object while assisting the owner in moving out of the residence. Liability was strongly contested.
    Injury: Client suffered a significant foot/ankle fracture with a resulting infection that required at least five surgeries to treat.
    Result: Six-figure settlement for five times more than the liability insurance company was offering the client before retaining our services.
  • Catastrophic Personal Injury: 74-year-old husband and 73-year-old wife – 2018
    Liability: Clients were struck from behind by an inattentive driver on the highway.
    Injuries: Husband suffered multiple fractured bones and joint injuries that left him largely confined to a wheelchair. Wife sustained significant hip injury requiring surgery and in-patient rehabilitative care.
    Result: Seven-figure settlement for limits of negligent driver’s liability insurance and limits of clients’ own underinsured motorist policy.
  • Wrongful Death Case: 57 Year Old Man – 2015
    Liability: Client was a bicyclist struck from behind while traveling upon the roadway.
    Result: Seven-figure settlement for the maximum policy limits after several months of investigation.
  • Catastrophic Personal Injury: 42 Year Old Father – 2014-2015
    Liability: Client was riding his motorcycle on US Highway when a vehicle attempted to cross the road, colliding directly with client’s left side. Liability was denied.
    Injury: Broken femur, fibula and tibia in left leg requiring surgically implanted rods to repair. Left arm was mangled in the collision with severe nerve and tendon damage. Client lost approximately 90% of the function of his left arm and hand. Client was knocked unconscious by the impact.
    Result: Seven-figure settlement for the maximum policy limits after several months of discovery.
  • Wrongful Death: 31 Year-Old Woman – 2013-2014
    Liability: Decedent was killed in an automobile collision caused by a drunk driver operating a vehicle owned by a prominent business. Defendant admitted liability.
    Result: Parties agreed to attempt to mediate the case prior to lawsuit being filed. Investigation, demand package and mediation statement completed in approximately 90 days. Case did not settle during mediation, but settled shortly thereafter on a mediator’s proposal for a confidential seven-figure amount.
  • Wrongful Death: 33 Year-Old Husband, Father of Two – 2012-2013
    Liability: Farmer was killed in a farm implement malfunction incident. Product liability lawsuit filed against the international manufacturer of the implement for faulty design. Corporate depositions taken outside United States. Mechanical engineering and economic experts retained by both parties.
    Result: Confidential seven-figure settlement reached in mediation.
